GENERAL CONDITIONS

1. DEFINITIONS

By signing the Registration Form, the Client accepts, after carefully reading the content of this document, these general conditions, the internal regulations of the Center, and the applicable data protection regulations.
For the purposes of these general conditions, expressly accepted by the Client, the following terms and expressions will have the meanings specified below:

• Client: a natural person who, by subscribing to the corresponding Registration Form / SEPA Mandate, accesses the services provided by DUIN.
• DUIN: means DUIN as defined in the Registration Form.
• DUIN SPA: means DUIN SPA & SPORTS, S.L.
• Contract: refers to the contract entered into between DUIN and the Client by subscribing to the Registration Form. These general conditions are also part of the Contract, as are the specific conditions established in the Center’s regulations.
• Center: refers to the Center where DUIN offers its services and which is detailed in the Registration Form.
• Registration Form: a document signed by the Client through which the Contract is formalized, including these general conditions.
• Access Device: refers to the access card, bracelet, QR code, and/or App (or any other device, mechanism, or access system provided by DUIN), which is personal and non-transferable, necessary to access the DUIN Center.
• Employee: refers to any worker of DUIN.
• Start Date: the date the Contract is signed by the Client. The start date (and with it the minimum commitment period) will be postponed if the Client benefits from a promotion offering a free training period. For example, if the terms of the promotion are as follows: “free until July 1st” and the registration takes place on May 12th, the start date of the Contract will be July 1st. During the promotional period (in the example, between May 12th and July 1st), the Client may access their Center without paying the corresponding fees, subject to the conditions of article 7. However, these general conditions will come into effect on the registration date.
• Registration date: the date on which the Client signs the Registration Form.
• Other Services: refers to the services, amenities, or courses that the Client can access at the Center by signing a specific contract and at an additional cost to the chosen fee.
• Center Regulations: specific regulations governing the activities carried out at the Center, which can be found on the website.
• Website: duinclub.com

2. SUBSCRIPTION OF THE CONTRACT

This Contract shall be understood as subscribed by the Client and thereby accepted in all its terms, through its in-person acceptance at the Center, by signing the Registration Form, regardless of whether the Client has completed the online registration form through the website.
This Contract will be governed by these General Clauses and the Center’s regulations.

3. RIGHT OF WITHDRAWAL

The Client shall have the right to withdraw from the contract within a period of 14 calendar days from its signing. To do so, they must go to the Center’s reception and submit the request.
Under no circumstances will the registration fees be refunded, as these correspond to a cost associated with the administrative process generated by the Client’s registration.
The prorated amount for the days prior to the withdrawal request will not be refunded, as the Client has been able to enjoy the services offered by the Center during those days.

4. SPORTS LICENSE

Article 62.4 of the Sports Law of Catalonia 1/2000, of July 31 (LDC), states that sports centers located in Catalonia that organize physical and sports activities must require that users of their facilities or services have the corresponding sports license for the activity practiced.

The Client declares that, prior to signing the Contract, they have been informed of the obligation to have a Physical Activity Sports License, which necessarily entails the obligation to contract an insurance policy that guarantees, with a sufficient amount, at a minimum, the coverage of the following risks:

• civil liability;
• compensation for cases of anatomical or functional loss, or death;
• healthcare for cases arising from sports practice.

The Client declares that they have understood these clauses which inform them of the obligation to have a Physical Activity Sports License, which necessarily entails the obligation to contract an insurance policy that covers possible accidents arising from physical practice within the Center.
By signing this Contract, the Client accepts the contracting and payment of the mandatory insurance in accordance with the LDC. Non-payment of this insurance will result in the prohibition of access to the Center by the Client and the automatic termination of the Contract.

Likewise, the Client expressly assumes and accepts the risks that may arise from carrying out physical activity at the Center, and waives the right to file any claim against DUIN in the event that they suffer an accident and cannot access the coverage and benefits provided for in the insurance policy subscribed in compliance with the provisions of the LDC and/or with respect to compensation for damages that this circumstance may cause.

5. FEES

At the time of contracting, the Client has chosen the Fee that is reflected in the Registration Form.
By selecting the Fee at the time of registration, the Client accepts its conditions.

• Adult fee: individual fee.
• Youth fee: intended for users according to their age. Users whose ages are between the following may benefit:
  • Duin Cotxeres Borbó: 18-24 years
  • Duin Magic Badalona: 14-24 years
  • Duin La Plana: 14-25 years
  • Duin Can Zam: 14-26 years
  • Duin Portitxol: 14-26 years
  • Duin Rambla del Fondo: 14-26 years
  • Duin Las Rozas: 14-25 years
  • Duin Jordi Mari: 14-24 years
  • Marisma: 15-30 years
  • Duin Pau Gasol: 14-26 years
  • Duin 25 de Setembre: 14-30 years

The month after exceeding the maximum indicated age, the corresponding individual adult fee will be automatically applied.
At the time of registration, underage users must be accompanied by their legal guardian, who must give their authorization.

• Senior fee: intended for users over 65 years of age.

6. COMMITMENT PERIOD

If the Client has chosen a fee with a commitment period, the conditions established in clause 6 of the contract will apply.
The fee with a commitment period has a monthly payment frequency, with the monthly amount fixed in the Registration Form.
The Client undertakes to maintain the chosen contract, without being able to request early termination.
The Client may request a temporary suspension of the contract according to the cases in clause 14; the time the Contract is frozen will not count towards the commitment period.
The termination of the Contract must be requested before the 20th day of the last month of the Contract.
The Contract will be tacitly renewed for the same period if the Client does not state otherwise.
In the case of a fee with a commitment period (4, 6, or 12 months), the Contract will have a minimum duration equal to the agreed period starting from the Start Date, and the Client irrevocably undertakes not to terminate it before the end of this period.

7. PROMOTIONS

If the Client benefits from any promotion, the conditions are detailed in the Registration Form.

8. PAYMENT

From the moment of signing, the Client is obliged to pay the selected fee according to clauses 5 and 6.
The Client authorizes automatic direct debit in favor of DUIN to charge the corresponding amounts.
The first payment and registration fees will be paid at the time of signing by card or online.
Subsequent payments will be made by SEPA direct debit.
Receipts will be presented for collection within the first five calendar days of each month.
The amount of the Contract will be reviewed every January 1st according to the CPI.
There will be no refund for unused fees.

9. NON-PAYMENT

In case of non-payment, DUIN may send new direct debits.
The administrative costs of the second direct debit will be borne by the Client (€3 per attempt).
The Access Device will be blocked until the situation is regularized.
DUIN may refer the debt to legal services and transfer data to collection agencies if the amount exceeds €50.

10. ACCESS DEVICE

The Client needs their Access Device to enter the Center. It is personal and non-transferable.
If it is lost or misplaced, a new one must be purchased (cost: €5).

11. CHANGE OF ADDRESS OR INJURY

If the Client changes their address, DUIN may transfer the contract to another center in the group.
If the Client cannot use the fee for medical reasons, they may terminate the contract early with 15 days’ notice.

12. TEMPORARY LEAVE

Only for medical or justified reasons, with a minimum duration of 3 months and a maximum of 6.

13. CANCELLATION OF THE FEE

It cannot be canceled before the minimum period.
The automatic renewal will be carried out according to the conditions of the fee.
The cancellation request must be made in writing before the 20th of the month.

14. RISK AND LIABILITY

The Client declares to know and accept the risks associated with sports and fitness activities, and waives the right to claim compensation from DUIN or its employees and collaborators.

15. PERSONAL DATA

The data provided will be processed to manage the relationship as a Client, as well as for administrative, tax, and commercial management.
The legal basis is the execution of the contract, legal compliance, legitimate interest, and express consent.
The data may be communicated to companies of the DUIN group both inside and outside the European Economic Area.

16. APPLICABLE LAW

These general conditions and the Contract shall be governed by the law of the Kingdom of Spain.
Any dispute arising from the Contract shall be submitted to the competent Courts and Tribunals.
